When you order a custom wheelset from Hartl Racing, you don't receive an "off-the-shelf" product, but a high-performance component manufactured precisely to customer specifications. We are frequently asked why the 14-day right of withdrawal is excluded for these specially manufactured spoke wheels.
In this article, we transparently explain the technical background and the legal situation under German and European consumer law.
1. The Technical Reason: Safety Relevance and Material Change
A spoked wheel is not a simple assembly kit that can be assembled and disassembled at will. It is a safety-critical part subjected to high dynamic loads.
During the manufacturing of a wheelset, crucial technical processes occur:
Specific Material Selection: Hubs, rims, spokes, and nipples are precisely assembled according to the color and dimension combinations chosen by the customer.
Intended Microstructural Change (Elongation): During lacing, tensioning, and high-precision truing, the spokes are subjected to extreme tensile stress. This leads to an intended, minimal plastic deformation (elongation) of the material and the seating of the nipples in the rim bed.
Prohibition of Use After Disassembly: Once laced and tensioned, spokes and nipples may not be used a second time for a new build for safety reasons. By detensioning and retensioning, they lose their structural integrity.
This means: A returned custom wheelset cannot simply be disassembled and put back into storage. The used spokes and nipples are unusable after disassembly and must be disposed of. This results in irreversible material and value loss.
2. The Legal Situation: Statutory Exclusion According to § 312g Abs. 2 Nr. 1 BGB
Distance selling law protects consumers when purchasing online. At the same time, the law protects retailers from unreasonable damages in the case of custom-made products.
According to § 312g Abs. 2 Nr. 1 BGB (as well as the corresponding EU Consumer Rights Directive), the right of withdrawal does not exist for contracts for the supply of goods:
"[...] which are not prefabricated and for the manufacture of which an individual choice or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer."
Distinction from Standard Products (BGH Case Law)
Reference is often made to BGH rulings (e.g., BGH VIII ZR 295/01) in which the right of withdrawal was granted for assembled PCs. This case law is not applicable to custom spoked wheels: PC components are plug-in systems that can be separated without destruction and without material loss. In the case of spoked wheels, however, the manufacturing process leads to an irreversible change in the components (spokes/nipples), the reversal of which is economically unreasonable for the retailer.
Since the wheelset is individually spoked and trued only after the customer's order, the statutory exclusion of the right of withdrawal fully and lawfully applies to Hartl Racing.
3. Transparency in Our Right of Withdrawal Information
In our right of withdrawal information, we inform – as required by law – both about the general 14-day right of withdrawal for standard stock items and about the statutory exceptions for custom-made products.
- Standard items (e.g., clothing, accessories): 14-day right of withdrawal.
- Spoked wheels manufactured to order (Custom Wheelsets): No right of withdrawal from the start of the manufacturing process.
- Stock wheelsets (immediately available): We also have pre-assembled wheelsets in stock. These are explicitly marked in the shop with the note "IMMEDIATELY AVAILABLE". For these already finished wheelsets, the regular 14-day right of withdrawal naturally applies.
